London Employment Law: FAQs

Do employment law disputes go to court?

Your dispute may not necessarily go to court. There are ways to reach an agreement outside of court such as ACAS conciliation and mediation. Our employment law team can act as a mediator between yourself and your employer or represent you in negotiations with your employer and their representation. 

However, if your dispute cannot be resolved outside of court GEC can provide representation at tribunal.

How long does it take to settle a claim?

Every claim is different and many factors can affect the length of a dispute. The claim will be largely affected by the process used to achieve a settlement. Often, settling outside of court produces a fairly quick resolution.

What is the process for a discrimination claim?

Typically the first stage is to raise your concerns with your employer. This allows an opportunity to resolve the issue internally. If you do not get an adequate resolution, the next stage is to begin a formal grievance process. 

Following this, if you are unsatisfied with the response, you can consider taking the matter to the Employment Tribunal. The first stage of this process is ACAS early conciliation. This process is designed to help you and your employer settle out of court. Conciliation can take a month and can be extended by a further two weeks if both parties agree. 

If at the end of conciliation, the matter is still unresolved you can issue a claim in the Employment Tribunal. Your employer will receive a copy of the claim and have 30 days to submit a defence. 

The tribunal will then set a date for 6 to 9 months time. 

When can I raise a dispute?

The time limit to start ACAS conciliation is 3 months minus a day from the last act of discrimination. It is important to get in touch as soon as possible to make sure you meet this deadline. 

What redress can you seek from discrimination by an employer?

If the case goes to court the outcomes could include compensation, declaration of your rights, and recommendations to prevent future discrimination by the employer. If the case is settled outside of court you may also be able to negotiate terms that protect your reputation, a confidentiality agreement, and an apology and reference. Negotiation outside of court is also often a less stressful process and can result in more preferable compensation.
