What is a Court Injunction?

The aim of a court injunction is to protect both adults and children from damaging activities, such as violence and harassment. These court orders prevent someone from doing something that is detrimental to someone else, and in a family law context are usually used for protection against domestic violence. Non-molestation order

A court injunction of this type is aimed at preventing your spouse, former spouse, partner or ex-partner from harassing you, your children or relatives. Molesting means harassing, pestering or intimidating and includes assault. In addition, a non-molestation court order can prevent your spouse, former spouse,  partner or ex-partner from getting another person to molest or harass you.

Occupation order

This order stipulates who can live in the family home and can also restrict the Respondent to such an application from coming within a certain distance of the home. Likewise to Non-Molestation Orders, these applications can be made against your spouse or former spouse  if you were married or against your partner or former partner in the event you were cohabiting. An occupation order can:

  • Allow you to remain in your home when your partner is trying to get you to leave
  • Allow you back into the home if your partner has already forced you to leave
  • State that you and your partner must live in separate parts of the home
  • Remove your partner from the home
  • Restrict your partner from entering the surrounding area or coming near

FAQs about Court Injunctions

How do you obtain injunctive relief?

An application for a Non-Molestation and/or Occupation Order needs to be made to the court. The application needs to include information in respect of the order you are seeking, the reasons why, and must be supported by evidence, normally in the form of a witness statement with supporting documentation. 

Are there different types of injunction orders?

Injunctions can either be interim or final. Interim injunctions are applied for at the beginning of a litigation process, and are in effect until further order takes place. Final injunctions are granted at the conclusion of a litigation claim, and can either be permanent or time-limited. 

Who can apply for an injunction order?

Anyone who needs to prevent damage or loss to an asset, or protect themselves from personal or reputational harm, can apply for a court injunction order. For the court to consider granting an injunction, there needs to be a substantive cause of action, whereby the other party is invading, or threatening to invade, your equitable rights. It’s also worth noting that injunctions are not standalone remedies for cases of harassment and defamation, and form part of greater claims made against a defendant. In a family law context, it is important to ascertain as to which category of prospective applicant you may fall under, especially so in respect of any application for an Occupation Order. How much does a court injunction cost?

Obtaining a court injunction can be an expensive process, so applicants need to be mindful of the costs associated before applying for any form of injunctive relief. The costs may vary depending on the complexities of your individual case, as well as the seniority of the fee earner and any Barrister instructed to represent you in Court. It is also important to recognise those cases where an injunction is being sought on an urgent basis which may come at added costs, especially if a large amount of work must be undertaken in a short space of time on your behalf. Additionally, as court injunctions are not acquired in isolation, the cost of the entire associated litigation process could be significantly higher than the injunction costs alone.
